Legal entity
You need a legal body to own land, sign leases, receive grants and donations, and keep liability off your personal name. Form it before serious fundraising or a purchase, choose one that can own land and is tax-recognised, and keep it to the scale you are at.
Options & pathways
- Start informal / under an umbrella — while testing, pre-funding. Nothing to set up, but can't cleanly hold land or grants, so only a stepping stone.
- Membership non-profit association (German e.V., Portuguese Associação) — small, low budget, member-run democracy. Cheap; needs minimum members, less commercial flexibility.
- Charitable company (German gGmbH) — for earned income or larger funding; flexible and credible, but costlier with share capital.
- Tax-privileged social status (Portuguese IPSS) — extra tax benefits where eligible, with more reporting.
Decision factors
Country decides the actual forms, costs, and timelines (see parameters/); budget rules out the expensive ones early; earned income points to a company, pure charity to an association. EU freedom of establishment lets you base the entity in one member state and operate in another.
